Asset Recovery / Assets and debts

Asset recovery

The procedure for the actual return of assets that have been diverted or withheld, by lawful means: interim measures, recognition of judgments in other countries, challenging transactions used to divert assets.

01

Practical significance

Asset recovery is a legal process that relies on analysis but is not itself analysis. Information shows where the assets are and how they got there; recovering them is only possible through the courts, enforcement officers, or settlement.

02

Where it is used

  • cross-border debt recovery
  • insolvency and corporate disputes
  • asset recovery after fraud
  • family and inheritance disputes
03

What the term does not mean

This does not mean seizure of assets by a private company. Any recovery action is carried out through the legal mechanisms of the relevant jurisdiction.

04

How it differs from «Asset Tracing»

Tracing answers the question "where are the assets and how did they get there", recovery answers "how to get them back". The former is information work, the latter is a legal procedure. More about this term
