Asset Tracing / Assets and debts

Asset Tracing

Tracking the movement of assets over time: from the original owner through re-registrations, sales and corporate chains to the current holders. Reconstructs not only "what exists" but also "where it went and how".

01

Practical significance

A key tool for enforcement and disputes: when assets have been moved to relatives and nominees, it is tracing that builds a demonstrable chain from the debtor to the property - the basis for challenging transactions and obtaining interim measures.

02

Where it is used

  • debt recovery where assets have been moved out
  • corporate and family disputes
  • bankruptcy proceedings
  • investigation of fraudulent schemes
03

What the term does not mean

Does not guarantee the return of property: tracing provides the factual chain, while the legal fate of the assets is decided by a court under the laws of the relevant jurisdiction.

04

How it differs from «Asset Search»

Search is a photograph of the current state; tracing is a film of the movement of assets with a chronology, grounds and participants for each transfer. More about this term

05

Illustrative example

A debtor's property was "sold" to his partner's mother a year before the dispute, then contributed to the capital of a new company. Tracing documents the chain and the dates - lawyers challenge the transactions.
