Pre-Litigation Intelligence
Analytical preparation for a legal dispute before it begins: reconstructing facts and chronology, locating materials, verifying participants and assessing the opponent's assets to understand the enforceability of a future decision.
Practical significance
Solves two tasks: strengthens the factual basis of the position and allows a sober decision on whether to litigate at all. Sometimes the main result of pre-litigation is a well-founded decision not to pursue a hopeless case.
Where it is used
- preparation of claims and defence
- assessment of the merits of proceeding
- choice of jurisdiction for the dispute
- preparation for negotiations under threat of litigation
What the term does not mean
Does not replace legal strategy and does not provide legal qualification: analysis supplies facts, decisions are made by the legal team.
How it differs from «Debt Intelligence»
Debt intelligence is focused on debt recovery; pre-litigation covers any dispute - corporate, family, contractual - and operates before the process begins More about this term
